Memorandum by Gay McDougall of the Southern Africa Project. The memorandum says on April 12, 1982, Transnuclear, Inc. filed an application with the Nuclear Regulatory Commission for a license to export uranium in the form of UF-6 containing a maximum 3.30 percent U-235 to South Africa as the ultimate consignee. The memorandum says the export sought by this license application is currently prohibited by law; since 1978, U.S. law has prohibited the export of nuclear materials to countries that fail to maintain "full-scope safeguards", as defined by the International Atomic Energy Agency (IAEA), for peaceful usage on all their nuclear facilities; as a result, the U.S. has held up uranium shipments to South Africa because its safeguards are incomplete. The memorandum asks people to submit an intervention petition and a request for both adjudicatory and legislative hearings. The memorandum asks people to send written comments opposing this export licensing application to Mr. James Shey, Office of International Programs, U.S. Nuclear Regulatory Commission and Mr. Carlton R. Stoiber, Director, Office of Nuclear Export and Import Control, Bureau of Oceans and International, Environmental, and Scientific Affairs, U.S. Department of State. The memorandum includes a letter by James V. Zimmerman of the Nuclear Regulatory Commission with an application from Transnuclear, Inc. for licenses to export special nuclear material to South Africa for use as reload fuel for the Koeberg Nuclear Power Plant. The memorandum discusses the 1954 Atomic Energy Act, the 1978 Nuclear Non-Proliferation Act, the Treaty on Non-Proliferation of Nuclear Weapons (NPT), and the Nuclear Nonproliferation Act.
